Official Rules & Regulations

Promotion valid from January 1, 2009 to April 30, 2009, and subject to limited supplies of Scratch 'n' Skate game pieces.

  1. Eligibility. The Emerica Scratch 'n' Skate promotion is open to legal residents of the United States, except those residing in Rhode Island, Vermont, Florida, New York or where restricted or prohibited. No reproductions, facsimiles or photocopies will be allowed and will result in disqualification. Limit one game card per person. Current and former employees of Sole Technology, Inc. and its advertising agencies, members of the media, employees of TransWorld Skateboarding, printers, and companies involved with the creation or distribution of the Emerica Scratch 'n' Skate game card are not eligible to participate in this promotion.

  2. Distribution of Game Cards. The game card shall be inserted in and distributed along with TransWorld Skateboarding magazines. NO PURCHASE NECESSARY. Limit one game card per copy of said magazine. If you would like to receive a free game card, send a self-addressed stamped envelope to Sole Technology, Inc: 20162 Windrow Drive, Lake Forest CA 92630, ATTN: Emerica’s Braydon Szafranski Scratch 'n' Skate Promotion. Each request must be mailed separately, and must be original and handwritten. Only one alternate entry request allowed per person for entire promotion.

  3. How to play. To reveal their prize, customers must scratch off the prize area on the game card. Contestants will win the prize revealed. Prizes must be claimed within five business days of Sole Technology’s verification of your prize claim. . No other giveaway claims will be honored after the promotion. Limit one prize per person.

  4. Prize Breakdown. No prizes can be exchanged for cash, unless Sole Technology elects, at its discretion, to award the corresponding cash value in lieu of the actual prize. Unclaimed prizes will not be awarded. The prize breakdown is as follows:

    Grand Prize (up to one winner): Free trip for two (if winner is under 18, they must be accompanied bya parent or authorized guardian) from within the continental United States to Lake Forest, California, where Grand Prize Winner will have the chance to spend a day with Braydon Szafranski. Cash value: $5,000.

    Runners-Up (up to 100 winners): One pair of Emerica Braydon Szafranski shoes, or if unavailable, any style of Emerica shoes of Sole Technology’s choosing. Cash value: $75.

    Second Runners-Up (up to 500 winners): One Emerica Cee-Lo Dice Kit. Cash Value: $10.

    Prize-winning Scratch 'n' Skate game card(s) claims must be submitted to Sole Technology within five business days after the end of this promotion, and shall be subject to Sole Technology’s verification. Contestants must sign the back of the game card, and submit the original card along with a photocopy of the front of the card, and a copy of their valid personal identification card (driver’s license, social security card, or passport). Contestants also are required to retain a legible photocopy of the valid game card for their records. Contestants may be required to take and pass a polygraph test to confirm official rules compliance and to confirm no tampering of game card or fraud of any kind has occurred. Send winning game card via traceable shipping carrier (UPS, Fed-Ex, etc.) to: 20162 Windrow Drive, Lake Forest CA 92630, ATTN: Emerica Braydon Szafranski Scratch 'n' Skate Promotion. Sole Technology shall not be responsible for any lost or misdirected shipments. No prizes shall be awarded to contestants unless such contestant executes a notarized affidavit and release in favor of Sole Technology, in such form and with such terms and conditions as Sole Technology may require.

  5. Taxes. Liability for any and all federal, state, and local taxes rest solely with the prize winners. Any winner holding a game card valid for any prize worth $500 or more must sign an official affidavit, confirming compliance with these rules and regulations of the promotion, and fill out a W-9 form for tax purposes.

  6. Judging. Sole Technology management reserves the right to interpret all questions and conditions regarding this event, without claim for damages or recourse of any kind. All questions not covered in these rules will be decided by the management of Sole Technology, its decision to be final. In the event that the Scratch 'n' Skate game cards are unable to be scratched off due to deficient screening ink on the cards, deficient printing of the cards, or other potential malfunction of the cards, each person redeeming their card will be asked to complete a name and address form. All cards redeemed that are unscratchable or otherwise unreadable will be given a random prize selected from the assortment of non-cash prizes available.

  7. General. By participating in this promotion and accepting the prize, winner(s) release Sole Technology and its affiliates, subsidiaries, advertising, promotional and production agencies from any and all liability, loss, harm, damage, cost or expense, including all reasonable counsel fees and court costs incurred and including, without limitation, lost mail, a lost or damaged game card, property damage, personal injury and/or death which may occur in connection with acceptance and/or use of the prize. By participating in this promotion, winners also grant Sole Technology permission to winner’s use name and photo for promotional purposes. The contest rules shall be interpreted according to the substantive laws of the State of California, without regard to its choice of law principles. Jurisdiction for any litigation arising from these contest rules and/or the contest itself shall lie exclusively with the appropriate courts in the County of Orange, California.

If by reason of a printing error or other error, more prizes are claimed than the number set forth in these official rules, all persons making purportedly valid claims will be included in a random drawing to award the advertised number of prizes available in the prize category in question. No more than the advertised number of prizes will be awarded. 

This contest is subject to these Official Rules and any other rules at any time promulgated by Sole Technology. Sole Technology reserves the right to amend these rules at any time in its sole discretion. In the event that any provision or rule is found unenforceable by any court of appropriate jurisdiction, such provision or rule shall be severed herefrom and the remainder of the Official Rules shall remain valid and enforceable.
